NOTICE TO REMOVE
CUMULATIVE VOTING
FROM OUR BY LAWS
ON DECEMBER 5, 2006, PROPERTY OWNER
SIGNED PETITIONS, REPRESENTING MORE THAN 5% OF THE 2009
ELIGIBLE PROPERTIES, WERE PRESENTED TO THE BOARD OF
DIRECTORS OF THE RANCHO TEHAMA ASSOCIATION.
THIS NOTICE IS TO INFORM THE RANCHO
TEHAMA PROPERTY OWNERS THAT THE BALLOTS TO DECIDE THIS
ISSUE WILL BE MAILED OUT ON THURSDAY, MARCH 15, 2007,
AND MUST BE RETURNED NO LATER THAN SATURDAY, APRIL 28,
2007.
THE DATE FOR TABULATION WILL BE AT
A SPECIAL MEETING HELD ON MONDAY, APRIL 30. 2007.
How cumulative voting works:
If there are three directors running
for office (as in the last Board of Director Election),
under cumulative voting, members have 3 votes which
may be distributed in any manner they choose (as long
as no more than 3 votes are cast):
| 3 votes for one candidate, or |
| 2 votes for one candidate and 1
for another, or |
| 1 vote each for 3 candidates |
The following is quoted from the
Petition and the "Davis-Stirling Newsletter":
"Cumulative voting increases the cost
and uncertainty of elections and increases the potential
for error and legal challenges. To address this problem,
associations should adopt conventional voting systems,
i.e., casting no more than one vote for each candidate---the
same election process used in city, state and national
elections. This forces candidates to seek a broader
base of support thereby increasing the likelihood that
more moderate, business-like candidates, rather than
disruptive, fringe candidates, will be elected.
To implement a conventional voting process,
associations must amend their governing documents to
delete cumulative voting."
